1. The Contract

Please go through the following terms and conditions which will help you to clarify the relationship between the hosts and clients, and Nepal Alibaba Treks and Tours Pvt Ltd, we are here for you and referred as ‘‘The company’’ Register no.205866/075/076,  Note it down because it is necessary while booking your trip, so this is how you are going to agree on and bounded by Terms and conditions as well as certain limitations of liability and cancellation policy. Terms and conditions need to be agreed upon by both parties to resolve all the legal disputes and other various things that may also arise during a trip.

2. Booking a Trip

The activities that refer to any kind of product itinerary or programs that buy with us including Tours, Expeditions, Trekking, and other tour programs and adventure activities. A booking is accepted and also becomes definite only from the date when the travel agency sends a confirmation email or invoice. It is also the point in which a contract between the firm and client that directly comes into existence. When your booking is already confirmed and a contract with the firm comes into force. The company or agency that reserves their rights to ascend or descend the prices of the brochure. It is also necessary to note down that the company would not be able to liable to any collateral agreement, Description of services, or conditions  Warranty, prior agreement other than expressed herein.

3. Deposit Requirement

a) Trips to Nepal:

You need to make a nonrefundable deposit of 25% of the total trip cost at the same time during booking your trip when you plan to visit Nepal. You can also have another option to pay the remaining amount when you arrive in Kathmandu and before the trip of a departure. A non-refundable deposit that should be sent to the firm or the agent of a company. The tailor-made trips made by the company may require a higher number of deposits or overall payment during the time of booking. If your deposit is somehow different from the outlined in the clause in which you will be advised by the company at the time of the booking of your activities.

b) Tibet/India/ Bhutan Trips

At the time of booking of the activities, a non-refundable deposit of 25% is along with the due of airfares if the clients want to the company make it arrange before your trip departure in 21 days. So if your booking details are 11 days or less than a prior to departure then your full payment is due.

Method of payment: Your booking deposits can be made within a bank transfer by the credit card system (MasterCard or Visa). Please follow the following instruction that is provided on the booking form.

1. Payment by the credit card system (Visa only or Master Card)

You need to complete the necessary information in the form including your signature (which is the same as in your credit card & passport) and credit cards.  Click here to download the form by (*PDF VERSION). Fax to ………. OrE-mail the filled form to Nepal Alibaba Treks and Tours P. Ltd. Then your credit card system will be charged by Mega Bank p. Ltd ( Credit card Division) on behalf of Nepal Alibaba Treks and Tours P. Ltd.

And make sure that you should not make any mistakes while sending the form directly to the  Mega Bank service P. Ltd. Please also send a copy of your passport or any type of type ID copy along with the filled form. There is a charge of 4% when you make your payment with the credit card.

2. Payment through the Bank transfer/via wire

It is almost necessary to note down that we are not even liable to the loss or any delay during the process of transfer. If in such case due to the use of mediator bank or any kind of reasons if the money received by us is absolutely less than the amount sent, You are also requested upon the arrival to pay accordingly so that the cost of the product is equivalent. E-mail our company with the bank reference number or the remittance slips after you, make an initialization by transferring.

Sometimes bank also forwards the money with different names such of them are Remittance number/reference slips and sender details, so it makes easy to check the details.

3. Acceptance of booking/ Final payment/Client details:

a) Trips to Nepal

Final payment to Tours, trekking, expeditions, climbing, or any kind of tour in Nepal that can be made upon in Nepal. A final payment can be made by the help bank transfer credit card or by cash ( Visa or Master Card). There is also a charge of 4% when the payment is made by the cards That also applies to all of the payments such as deposits, trip extensions, miscellaneous purchases, and final balances.

b) Bhutan/ India/ Tibet Trips:

Regarding the trips in Bhutan, India, and Tibet the final payment of the trip start date should be 21 days prior.

4. Cancellation by Clients

Any of the cancellations that are made by the clients must be in the writing and acknowledged by the company. The date or time when the requests to cancel the program which is received by the company or their agents will also determine the cancellation applicably.

The cancellation charges that should be expressed hereafter as a percentage of the total trip price. Cancellation 60 days or more before departure: Loss of deposit.

Cancellation 59-21 days before departure: 50% of the cost of services booked.

Cancellation less than 21 days before departure: 100% of the cost of services booked.

The client has strongly advised to takeout all the cancellation insurance at the time of making the booking. Please note that no refunds will be made if you voluntarily leave a trip for any reason after the trip has begun. No refunds will be made for any accommodation, transport, sightseeing, meals or services not utilized.

5. CANCELLATION OF A TOUR BY THE COMPANY:

The Company reserves the right to cancel any tour programs that you booked unless guaranteed to run.

Nepal Alibaba Treks and Tours Pvt. Ltd reserves the right to cancel any programs related to trips, including a guaranteed trip, prior to departure due to reasons beyond its control (i.e. due to natural disasters, flight cancellation, consequences of strikes, industrial action, wars, riots, sickness, quarantine, government intervention, weather conditions,or other untoward occurrences. In such a case, Nepal Alibaba Treks and Tours Pvt. Ltd will refund the trip price only. If The Company cancels a departure that is guaranteed to run, we will refund the trip price, or you can be scheduled for the alternative trip at the same time if you are ready to consume it with the same value.

Please also note that significant alterations do not include a change of airline carrier, flight time tables or itineraries provided the departure and arrival dates remain unchanged, the substitution of a vessel, modification of itineraries, and change in cabin category or hotel accommodation provided it is of the same category.

The Company is not responsible for any incidental expenses or consequential losses that the Client may have incurred as a result of the booking such as visas, vaccinations, non-refundable flights or rail, nonrefundable car parking or other fees, loss of earnings, or loss of enjoyment, etc.

6. MEDICAL CONDITIONS AND SPECIAL REQUIREMENTS:

The Company must be known about your health condition in the writing at the time of booking, physically challenged conditions or any other mental and or physical condition which may affect fitness to travel and or any medical condition. If you fail to notify the Company, then it may lead to the client being refused to travel. If there is any failure to notify the Company of any such condition that results in cancellation will result in 100% cancellation fees to the Client. Some trips may be unsuitable for Clients due to mobility, age, pregnancy or physical or mental conditions.

It is the Client’s responsibility to check prior to booking. The Company is not required to provide any special facilities unless it has agreed to do so in writing. The Company will do its best to meet Clients’ special requests including dietary, but such requests do not form part of the Contract and therefore the Company is not liable for not providing these requests. Medical facilities vary from country to country and the Company makes no representations and gives no warranties in relation to the standard of such treatment.

7. TRAVEL INSURANCE:

Adequate and valid travel insurance is compulsory for all travelers. Your travel insurance must cover accidents, injury, illness, and death medical expenses, including any related to pre-existing medical conditions, emergency repatriation (including helicopter rescue and an air ambulance were applicable) and personal cost as a liability. The Company also recommends it covers trip cancellation, curtailment, and loss of luggage and personal effects. You must carry proof of insurance with you and produce it if reasonably requested by the company employees or suppliers. The company reserves the right to cancel or suspend your participation on a trip or in certain activities that comprise part of a trip, at any time, including after the commencement of your trip, with no right of refund, if you are unable to provide proof of insurance when requested.

8. FLIGHT DELAYS AND CHANGES IN THE ITINERARY:

Please note that mountain adventures are always unpredictable. Bad weather in mountain regions can cause domestic flight delays. In case of delayed domestic flights,  Nepal Alibaba Treks and Tours Pvt Ltd will meet departing city accommodation (Guest House) and food (Lunch & Breakfast) costs prior to your trip. However, in case of delayed return flights, the client is responsible to bear all additional expenses including food and accommodation costs. If you wish to make alternative arrangements such as Helicopter flight to avoid flight delays, all additional costs would be your responsibility. Moreover,  does not accept any responsibility for costs incurred as a result of a missed international flight but would assist to make alternative arrangements wherever possible. Please also note that while on the field, we may have to make some changes in the itinerary due to unforeseen circumstances.

9. TRIP AMENDMENT:

If the booking amendment request is received by  Nepal Alibaba Treks and Tours Pvt Ltd 21 days or more prior to your original trip departure, the company will make the necessary amendment with a charge of US$100 per person. In case you wish to make amendments within 21 days of the trip departure, the cost of the amendment may be higher depending upon the company’s arrangements with other parties such as hotels, Guest Houses, ground operators or airlines.

10. VISA & PASSPORT:

You must carry a valid passport and have obtained the appropriate visas when traveling with Nepal Alibaba Treks and Tours Pvt Ltd. Please ensure your passport is valid for 6 months beyond the duration of the trip. Nepal Visa is available on arrival in Nepal. For Tibet & Bhutan, the company can make necessary arrangements upon request.

For India, the client will have to acquire a visa from their own home country. It is your responsibility to ensure that you are in possession of the correct visas for the countries you are traveling to Nepal Alibaba Treks and Tours Pvt Ltd cannot accept responsibility if you are refused entry to a country or places because you lack the correct visa documentation.

11. INJURIES AND EVACUATION:

Nepal Alibaba Treks and Tours Pvt Ltd would not be liable for any injury/health conditions/emotional or other conditions suffered by the client during the trip. Similarly, our package cost does not include any personal insurance. Hence, we advise the clients to take adequate insurance packages, including medical emergencies and evacuation by Helicopter.

12. SERVICES MISSED OR UNUSED:

There will be no discounts or monies refunded for missed or unused services, this includes voluntary or involuntary termination/departure from tour, i.e. sickness, death of a family member, etc, late arrival on the tour, or premature departure either voluntarily or involuntarily.

13. UPDATING OF TERMS AND CONDITIONS:

The Company reserves the right to update and amend these terms and conditions at any time. It is the responsibility of the Client to keep updated with any changes. The current version of terms and conditions will always be found on the website www.nepalalibabatreks.com and will be the terms referred to in any dispute.
